Privacy Policy

Silent Beacon, LLC (“we,” “our”, “us” or the “SBL,”) is committed to protecting the privacy of the company contracting with us for a business portal (“Company”), the Company’s representatives  and the Company’s associates to whom the Company provided Silent Beacons (collectively, “End Users”). We understand in this day and age how important this is to us and our End Users. The SBL does not sell the End Users’ data to any external third-party vendors. Information is used solely by us and our third-party service providers. This Privacy Policy explains our practices regarding the collection, use, disclosure, and protection of information that is collected through the devices known as the Silent Beacons (Beacons”), SBL’s mobile software application (“the App”), a portal software system that allows Customer to monitor Beacon Holder safety and to send out and receive safety alerts (the “Portal”), related maintenance and support services, and, if purchased, emergency monitoring services from SBL’s third party provider (collectively referred to herein as the “System”).  The License and Lease Agreement between SBL and you (“Agreement”) is incorporated by reference.  Any capitalized term not found in this Privacy Policy will have the same meaning as found in the Agreement. This Privacy Policy does not cover any information collected by any affiliates or other third parties unless specifically stated.

Definition of Personal Information

 

In this Privacy Policy, the term “personal information” means any information relating to an identified or identifiable natural person; an identifiable person is one who can be identified, directly in particular by reference to a name, phone number, an identification number, location information, or the unique identifier allocated to the Beacons.

Definition of Non Personal Information

 

“Non-personal Information” is information about the Company or End Users that is not personally identifiable, such as Internet Protocol (IP) address, browser type, host operating system, and other basic website statistical information that cannot identify a particular person.

Personal Information

 

We use this information to operate, maintain, and provide to you the features and functionality of the System and to communicate directly with you, such as to send you alerts on the movements of your End Users’ members, crime alerts in your neighborhood, etc. You can control who receives email alerts, push notifications, voice calls and text alerts through the System.  We may also send you emails (e.g., account verification, parental consent notification, order confirmations, change or updates to features of the System, technical and security notices). You may not opt-out of these e-mails. We will further generate, and store within your online account (the “Account”), a unique identifier allocated to each of your Beacons.

Registration and Profile Information

 

When you create an Account, we may collect your End Users’ personal information such as first and last name, email address, and mobile phone number.

Application Geo-location Information

 

We collect your End Users’ location through GPS, WiFi, or wireless network triangulation in order to obtain the location for the purposes of providing the System. GPS is only stored when an alert triggered by the System is activated and the GPS service from a qualifying smartphone, tablet or other compatible Bluetooth® device (each, a “Host”) is enabled and stores such location with any messages, data or incidents that you transmit through the System. This information is stored and transmitted to the contacts you have stored within the System.

Integration of Third Party Web Analysis and Social Functionalities

 

The SBL’s Website, like many other websites, uses “cookies” and similar tools to help improve the user’s System. “Cookies” are small files that recognize repeat visitors. Your End Users’  should be able to control the use of cookies through their internet browser. Whether or not to allow cookies their choice. If an End User decides to block the use of cookies, then certain aspects of our Website may not be available to End Users or function as designed. We may use some of this Non-personal Information for internal purposes.

How we Use and Process your Personal Information

 

We will use and process your End Users’ personal information from your registration and usage of our System (including your location information and your Host’s location information) to provide the Company with our object location services, e.g., to help the Company use the GPS tracking capabilities while the Beacons are connected to the System through the Host.

In addition, we may use and process End Users’ personal information (including location information and your Host’s location information):

To provide the Company with support and handle requests and complaints.

To send updates, notices, and additional information related to the System.

To create anonymous, statistical and aggregated data and reports (i.e., in a form where such data does not enable the identification of a specific user).

To comply with any applicable law and assist law enforcement agencies under any applicable law, when we have a good faith belief that our cooperation with the law enforcement agencies is legally mandated or advisable, or that meets the applicable legal standards and procedures.

To prevent fraud, misappropriation, infringements, identity theft and other illegal activities and misuse of the System.

Use and Sharing of your Host’s Location Information

 

Whenever the System is activated on a Host, we will collect detailed location information about any Beacon in reach of such Host, as collected and sent to us by the App.

Any location information we receive from the System will be stored by us on our server. Such information can be associated by us with the Account for which the Beacon has been activated (by linking the Beacon’s unique device identifier with the account information).

An End User’s location information will be completely anonymous to users other than the Company and the Company’s representatives, unless an End User actively decides to share these data, e.g., by choosing to share access under an Account with other people the End Users’ trust, or by using social networks. We will not identify End Users personally to other users or otherwise make the End Users’ location information available to any third party in personal identifiable form without your prior consent.

Use and Sharing of your Personal Information

 

We will not rent or sell your personal information to third parties outside of SBL and its controlled subsidiaries and affiliates without the Company’s consent, except as noted below:

We share your information, including name, email, phone number and geo-location, with the users an End User has personally stored within the System.

We may share your personal information with our third-party business partners, vendors and consultants who perform services on our behalf, such as accounting, managerial, technical, marketing or analytic services. These business partners will be given access to End Users and your information as necessary to deliver the services under reasonable confidentiality terms.

Except as described above, we will not disclose personal information to third parties (including law enforcement, other government entity, or civil litigant) unless required to do so by law or subpoena or if in our sole discretion, we determine it is necessary to (a) conform to the law, comply with legal process, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Use, take precautions against liability, to investigate and defend ourselves against any claims or allegations, or to protect the security or integrity of our System; and/or (c) to exercise or protect the rights, property, or personal safety of SBL, End Users, the Company or others.

 

How We Protect Your Information

 

The SBL cares about the security of your information and uses commercially reasonable physical, administrative, and technological safeguards to preserve the integrity and security of all information we collect and that we share with our service providers. However, no security system is impenetrable and we cannot guarantee the security of our systems 100%. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

Choices About Your Information

 

You may, of course, decline to submit any personal information through the System which will degrade our ability to provide accurate and timely service, or render the System unusable.

Modifying Your Personal Information

 

You may modify your Account information, update or amend End Users’ and Company representatives’ personal information. As noted above, you may not opt out of System related communications (e.g., account verification, parental consent notification, order confirmations, change or updates to features of the System technical and security notices). If you have any questions about reviewing or modifying your account information, you can contact us directly using the contact information at the bottom of this Privacy Policy.

Maintaining Personal Information

 

We will retain information during the duration of the use of the System and up to seven (7) years thereafter.

Opting Out of Collection of Tracking Data

 

The only way to completely “opt out” of the collection of any information through cookies or other tracking technology is to actively manage the settings on your Host. Please refer to your browser’s technical information for instructions on how to delete and disable cookies, and other tracking/recording tools. (To learn more about cookies, clear gifs/web beacons and related technologies, you may wish to visit the Network Advertising Initiative’s online resources, at http://www.networkadvertising.org.) Depending on your Host, you may not be able to control tracking technologies through browser settings.

Links to Other Web Sites and Device Services

We are not responsible for the practices employed by websites or services linked to or from the System, nor the information or content contained therein. Please remember that when you or your End Users use a link to go from the System to another website or platform, our Privacy Policy does not apply to third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link on our website, are subject to that third party’s own rules and policies. Please read over those rules and policies before proceeding.

Changes to Our Privacy Policy

The SBL may, in its sole discretion, modify or update this Privacy Policy from time to time, and so you should review this page periodically. When we change the policy, we will update the ‘last modified’ date at the top of this page. If there are material changes to this Privacy Policy or in how the SBL will use your personal information, we will notify you either by prominently posting a notice of such changes prior to implementing the change or by directly sending you a notification.
